Sigma Revenue – Terms of Service
Effective date: 3 January 2026
These Terms of Service (“Terms”) govern access to and use of the Sigma Revenue website and software platform operated by Сигма Ревеню ООД / Sigma Revenue OOD (“Sigma Revenue”, “we”, “us”, “our”).
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.
1. Definitions
- “Company” means Сигма Ревеню ООД / Sigma Revenue OOD.
- “Customer” means the legal entity entering into an agreement with Sigma Revenue.
- “Authorized User” means an individual authorized by the Customer to access the Services.
- “Services” means the Sigma Revenue revenue management software and related services.
- “Platform” means the software accessible at app.sigmarevenue.com.
- “Customer Data” means data provided or made available by or on behalf of the Customer through the Services.
- “Documentation” means user guides, help materials, and other documentation provided by Sigma Revenue.
- “Order Form” means any written or electronic ordering document referencing these Terms.
2. About Sigma Revenue
Sigma Revenue provides a software-as-a-service (SaaS) revenue management system designed for hotels and similar accommodation providers, supporting pricing and revenue optimisation based on data inputs and algorithms.
The Services provide decision support and recommendations. Final pricing and inventory decisions remain under the Customer’s control.
3. Scope of the Agreement
These Terms apply to:
- use of sigmarevenue.com;
- use of the Platform;
- all related services, trials, demos, and support.
If there is a conflict between these Terms and an Order Form, the Order Form prevails.
4. Account Registration and Access
4.1 Account creation
Access to the Platform requires an account. Accounts are created by Sigma Revenue or by Customer administrators.
4.2 Authorized Users
The Customer is responsible for:
- managing Authorized Users;
- ensuring users comply with these Terms;
- all activity conducted under its accounts.
4.3 Credentials
Authorized Users must keep login credentials confidential. The Customer must notify Sigma Revenue promptly of any unauthorized access.
5. Use of the Services
5.1 Permitted use
The Customer may use the Services solely for its internal business purposes in accordance with these Terms and the Documentation.
5.2 Restrictions
The Customer must not:
- copy, modify, or create derivative works of the Services;
- reverse engineer or attempt to extract source code;
- use the Services to violate applicable laws;
- interfere with or disrupt the Platform;
- use the Services to develop or benchmark competing products.
6. Customer Data
6.1 Ownership
As between the parties, the Customer retains all rights to Customer Data.
6.2 License to Sigma Revenue
The Customer grants Sigma Revenue a limited, non-exclusive license to process Customer Data solely to provide, maintain, and improve the Services.
6.3 Data protection
Personal data is processed in accordance with our Privacy Policy, which forms an integral part of these Terms.
6.4 Anonymized data
Sigma Revenue may use aggregated and anonymized data (which does not identify the Customer or individuals) for analytics, benchmarking, and product improvement.
7. Integrations and Third-Party Systems
The Services may integrate with third-party systems (e.g. PMS, channel managers).
Sigma Revenue is not responsible for:
- third-party systems or data accuracy;
- availability or security of third-party services.
Integrations are configured at the Customer’s discretion and risk.
8. Fees and Payment
8.1 Fees
Fees are specified in the applicable Order Form and may include:
- a subscription fee (e.g. per room, with a minimum monthly fee);
- optional onboarding or professional services fees.
8.2 Payment terms
Unless otherwise agreed:
- fees are billed monthly or annually in advance;
- invoices are payable within 14 days;
- prices are exclusive of VAT and applicable taxes.
8.3 Late payments
Sigma Revenue may suspend access for overdue payments after reasonable notice.
9. Free Trials and Early-Stage Features
Sigma Revenue may offer free trials, beta features, or early-stage functionality.
Such features may be modified, limited, or discontinued at any time and are provided “as is”.
10. Intellectual Property
10.1 Sigma Revenue IP
All intellectual property rights in the Services, Platform, and Documentation belong to Sigma Revenue or its licensors.
10.2 No transfer
These Terms do not transfer ownership of any intellectual property rights to the Customer.
11. Confidentiality
Each party may receive confidential information from the other.
Both parties agree to:
- keep such information confidential;
- use it only to perform under these Terms;
- protect it with reasonable care.
This obligation survives termination.
12. Service Availability and Support
Sigma Revenue aims to provide reliable Services but does not guarantee uninterrupted availability.
Maintenance, updates, or outages may occur. Support is provided according to the Customer’s subscription level or Order Form.
13. Warranties and Disclaimers
13.1 General disclaimer
The Services are provided “as is” and “as available”.
13.2 No guarantee of results
Sigma Revenue does not guarantee:
- revenue increases;
- occupancy levels;
- pricing outcomes.
All pricing and inventory decisions remain the Customer’s responsibility.
13.3 Legal disclaimer
To the maximum extent permitted by law, Sigma Revenue disclaims all implied warranties, including merchantability and fitness for a particular purpose.
14. Limitation of Liability
To the maximum extent permitted by law:
- Sigma Revenue shall not be liable for indirect, incidental, special, or consequential damages.
- Sigma Revenue’s total liability in any 12-month period shall not exceed the fees paid by the Customer during that period.
Nothing limits liability for:
- fraud or willful misconduct;
- liability that cannot be excluded by law.
15. Indemnification
The Customer agrees to indemnify and hold Sigma Revenue harmless from claims arising out of:
- Customer Data;
- misuse of the Services;
- violation of these Terms or applicable law.
16. Term and Termination
16.1 Term
These Terms remain in effect for the duration of the subscription.
16.2 Termination for convenience
Termination terms are governed by the Order Form.
16.3 Termination for cause
Either party may terminate immediately for material breach not cured within a reasonable period.
16.4 Effect of termination
Upon termination:
- access to the Services ceases;
- Customer Data is handled in accordance with the agreement and Privacy Policy.
17. Changes to the Services or Terms
Sigma Revenue may update the Services or these Terms from time to time.
Material changes will be communicated or published on the Website. Continued use constitutes acceptance of updated Terms.
18. Governing Law and Jurisdiction
These Terms are governed by the laws of Bulgaria.
The competent courts of Sofia, Bulgaria have exclusive jurisdiction.
19. Assignment
The Customer may not assign these Terms without prior written consent.
Sigma Revenue may assign them in connection with a merger, acquisition, or sale of assets.
20. Entire Agreement
These Terms, together with:
- the Privacy Policy;
- any Order Form;
constitute the entire agreement between the parties regarding the Services.
